Someone with an established relationship who is acting in good faith and can reliably convey the patient’s wishes

That ranked list covers medical treatment. It does not cover your checking account. Lose the ability to manage your own finances with no financial power of attorney on file, and your family’s only route runs through the courthouse.
The proceeding goes before the clerk of superior court in the county where you live, which for most of our clients means Henderson County or Polk County. Someone files a verified petition asking the clerk to adjudicate you incompetent. An attorney is appointed as your guardian ad litem unless you retain your own counsel.
A hearing is set for no sooner than 10 days and no later than 30 days after you are served, unless the clerk extends that window for good cause, for a multidisciplinary evaluation, or for mediation. The clerk or a jury must then find by clear, cogent, and convincing evidence that you lack capacity. Costs, including reasonable fees and expenses of counsel, are taxed against you if the court finds they were incurred for your benefit, unless the court finds that doing so would be inequitable.
North Carolina law itself treats guardianship as the last resort. The statute defines a power of attorney for health care or for finances as a less restrictive alternative, and it requires the petition to state which less restrictive alternatives were considered and why they are not enough. The first question the court asks, in other words, is whether you already handled this yourself.
What Signing Actually Gets You
A North Carolina financial power of attorney is durable by default. It survives your incapacity unless the document expressly says the opposite, so you do not need to hunt for a special durable version. It also takes effect the moment you sign it unless you write in a later date or triggering event, a choice worth making deliberately rather than by accident.
If a bank refuses outright, the statute has teeth, although delay by itself is not the trigger. A person presented with a properly acknowledged power of attorney generally has seven business days to accept it, refuse it for one of the specific reasons the statute lists, or request a certification, a translation, or an opinion of counsel. If they request one of those, they have five business days after receiving it to decide.
Missing the seven day mark alone is not treated as an unreasonable refusal, so the remedy attaches to a refusal that violates the statute rather than to slow processing. What they cannot do is insist on their own in house form when the document you brought reasonably appears to authorize the transaction, and a refusal that does violate the statute can lead to a court order mandating acceptance plus liability for reasonable attorney fees and costs.

The first is assuming the document outlives you. It does not. A financial power of attorney terminates when the principal dies, and a health care power of attorney is revoked by your death except for narrow authority over anatomical gifts, autopsy, and disposition of your remains if you granted it. Everything after that belongs to whoever administers your estate.
The second is assuming a divorce cleans this up on its own. It largely does. A decree of divorce terminates a former spouse’s authority as your financial agent unless the document says otherwise, and a decree of divorce or separation revokes a spouse’s authority as your health care agent, with any named successor stepping in. Even so, signing fresh documents is cleaner than expecting a bank to know your marital history.
The third is treating revocation as informal. If your power of attorney was registered with a register of deeds, tearing up your copy does not undo it. State law requires you to record an executed and acknowledged instrument of revocation in that same office, with proof of service on your agent.
